Declaration



I, the adopter, am over 18 years old, and accepted the guinea pig on the terms and conditions of Guinea garden (below)


I, The adopter do not have children under the age of 14 living with me. 

I, the Adopter, understand I am the sole career for any living animal, and it is my responsibility only to take care of the animal/s being adopted.  


I also agree to any updates I pass onto Guinea Garden may be passed onto 3rd parties.



I also agree that any updates and photos sent to Guinea Garden, can be used on social media and their website of/about the guinea pig/s, and their new life.



I agree to the donation fee for each Guinea pig, unless another form of donation has been arranged.



I understand that I am agreeing and consenting to the terms and conditions below, the moment the adoption fee, and/or guinea pig/s have been exchanged.



TERMS AND CONDITIONS (as of 15/03/22)




I, (adopter) agree, understand, and consent that I am legally bound and agreeing to all the terms and conditions below, from the moment I handover the adoption fee, and/or I become the new owner of the guinea pig/s.

*I am happy for you to have a "reserved pending adoption" against a guinea pig, as I appreciate people don't always want/can adopt within a day of application. 


*"Reserved pending adoption" will only last 2 weeks from your application date, and the date it ends will appear next to your name (first name only) on the website. This will be informative to myself, you and other potential adopters. 
* If you miss an adoption date, I will send a message. If I do not get a response in 24 hours from the message, your reservation will be removed. 
*If at any point during the adoption/surrender process, I do not get a response for 48 hours your application will not go forward. 
To specify. I will go forward with adoption with another adopter where there's interest or I will not hold space if your surrendering as I'm limited and it will be offered to another surrender. 

I (adopter) Understand that it is against Guinea Gardens Policy to adopt any animals from them, when I have children under the age of 14 living with me at home, for the saftey and precaution of the animal been adopted. 

I (adopter) Understand that It is my responsibility, or that of another responsible adult to take care of the animal/s and their needs. This includes feeding, cleaning, social, intellectual, and any other needs of any other animal! I am the adult that will feed, play, care for said animal/s 


I (adopter) have brought a pair, or have a cage mate already, of which I understand the bonding process involved with guinea pigs but also understand I can request help from Guinea Garden, if I need, and I know it's not Guinea Garden's fault if bonding goes wrong and injuries are caused due to the adopted guinea pig.



I promise to follow Guinea Garden's bonding advice. If I don't and bonding fails, which ends up with the adopted guinea pig, as a lone guinea pig, I will surrender the guinea pig back to guinea garden.



If I partake in allowing Guinea Garden to bond my guinea pig/s on site, I understand this could take up to a week or more, and I accept Guinea Garden will do their best to reduce the risk of injury during that time, however injury make occur, and this is not due to Guinea Garden been neglectful, but due to the fact they are animals and unpredictable at times.



It is Guinea Gardens responsibility to treat and care for any injuries during this time, in whichever way that is deemed in the best interest of the animal/s.



If you partake in a bonding session, under false pretences, which leads to the guinea pig/s been requested back as a lone guinea pig, or if refusal to adhere to the adoption fee once bonding has been successfully here at Guinea Garden, then Guinea Garden holds the right to hold onto your guinea pig until a suitable and appropriate solution has been arranged.



I accept the adoption fee/or and items is a donation and if the adopted guinea pig ends up with the guinea pig back in Guinea Garden's care again for no fault of Guinea Garden, then Guinea Garden cannot refund the donation.



Guinea Garden promises to offer lifelong support, and if down the line your are unable to continue caring, Guinea Garden cannot refuse surrender.



Guinea Garden requests that if you are no longer able to care at any point during the guinea pig/s lifetime, that they are surrendered back to us, to ensure their safety.



I accept that the deposit, if paid is not refundable unless there is an issue before the guinea pig leaves Guinea Garden, such as the guinea pig unexpectedly passes away, or turns out to be the wrong gender and therefore the adoption cannot proceed.



If a guinea pig unfortunately sexed wrongly by Guinea Garden, Guinea Garden promises to help right wrong, in whatever means reasonably possible. Options such as finding a new guinea pig/s or supporting through an unexpected pregnancy.



If Guinea Garden mistakenly re-homes a suspected pregnant guinea pig, then it is Guinea Garden's responsibility to take the Guinea Pig back and monitor the pregnancy, fostering the guinea pig/s until after birth, unless you decide you want at home support.



Guinea Garden cannot refuse to take any babies from an accidental litter accidentally caused from Guinea Garden sexing accidentally wrongly.

On adopting, you understand that guinea garden keeps in herds and not pairs, increasing chances of recieving a pregnant sow, due to pups been in the sow herd. 

However you also understand Guinea Garden removes male pups at 3 weeks old prior to sexual maturity to reduce this risk, but this simply reduces the risk and does not eliminate it. 



I have not been disqualified from owning or keeping animals, or had the deprivation order made under the animal welfare act 2006, and/or have an unspent conviction for offences related to animals.



I will not irresponsibly sell or part with the guinea pig



Guinea Garden can have further contact to ensure the adoption process has gone smoothly and successfully. .



Any information concerning the history and habits of the guinea pig is passed on to the adopter, and the adopter can request all documents/information concerning the guinea pig. This information is provided to assist with the adoption process and successful adoption of the guinea pig which has come into the care of Guinea Garden. All information is of the previous owners information (if any) and from statements, assessments, observations, and notes made by Guinea Garden. We cannot guarantee all this is correct, despite the effort to do so.



I also understand that guinea pigs can be prone to heart attacks, and can hide illnesses so that they can't be spotted. I also understand that some guinea pigs can lead shorter lives such as the runt of the litter, and if a guinea pig passes at an early age it's not due to Guinea Garden, and a lack of care.



The guinea pig is believed to be in normal health on leaving the animal establishment except where specific conditions have been made

known to the Adopter on the Adoption Form and the responsibility for and cost of any future veterinary or other treatment shall

be borne solely by the Adopter.



If a re-homed new-born guinea pig from Guinea Garden unexpectedly passes away before 1 year of age, Guinea Garden will do their best to find a new cage mate for the remaining guinea pig without expectation of a donation fee. If you wish to make a donation either by item or money Guinea Garden would appreciate it.



The animal's welfare is our priority and we will work with you to resolve any concerns or questions you have in respect of the Animal

Nothing in these terms will affect your legal rights including those under the Consumer Rights Act 2015 (and other consumer protection

laws). Please contact your local Consumer Advice or Trading Standards Department for more information about this.



Guinea Garden strongly advises the Adopter to arrange appropriate insurance cover against risks referred to in this Agreement and also

the costs of veterinary treatment.



The Adopter confirms that to the best of their knowledge and belief no person residing in their household, or who will care for the

Animal, is disqualified from keeping animals or has had a deprivation order made under the Animal Welfare Act 2006 and/or has an

unspent conviction for offences relating to animals.



Attention is drawn to the possible liability of the Adopter for damage and injury which they may cause to third parties or their property. In

particular liability may arise under the Animals Act 1971. The possibility of an action for nuisance against the Adopter as a result of the

Animal's behaviour should also be recognised. Guinea Garden strongly advises the Adopter to arrange appropriate insurance cover

against risks referred to in this Agreement and also the costs of veterinary treatment.



The Adopter agrees to comply with all relevant regulations, legislation and laws concerning the welfare, control, responsible ownership

and protection of animals including without limitation the Animal Welfare Act 2006 and Codes of Practice issued in England and Wales

under the 2006 Act and to ensure that anyone with the temporary care of the Animal also complies The welfare needs of the animal

means providing for the animal's health, happiness and taking measures to ensure that the animal's health is maintained, in that he/she

is properly housed, fed, watered, socialised and exercised and receives appropriate veterinary care.



Guinea Garden strongly advises that you look into possible neautring if you are to have a mixed herd.



Nothing in this Agreement shall exclude or in any way limit Guinea Gardens liability for fraud, or for the death or personal injury caused by

its negligence or any other liability or consumer rights which it cannot legally exclude or limit.



This Agreement is between the Adopter and Guinea Garden and no other party has the right to enforce the terms of this Agreement



If court or relevant authority finds any part of this Agreement to be unenforceable, the rest of the Agreement shall continue in force as

each of these terms operates separately.



The English and Welsh Courts will have exclusive jurisdiction over any claim arising from or related to this Agreement. English and

Welsh law will apply to this Agreement.




SURRENDERS:- 

Terms and conditions/Declaration (As of 31/08/20) 

I declare that the animal/s been surrendered to Guinea Garden are my pets and I am not surrendering any one else's pets without their knowledge. 

I am signing over all care rights of the animal named above to Guinea Garden.

The only input, care or contact with said animal will be through the contact method stated above for updates only. 

I agree to surrender guinea pig/s, and if I can, support the rescue with a donation.
